SOUTH BEND — Former South Bend attorney Eric Marshall, who has been accused in lawsuits of defrauding his clients, has now been criminally charged.
Marshall, 61, faces five counts of mail fraud in what the U.S. attorney called an “elder abuse scam” in a news release Wednesday.
Marshall specialized in elder law, worked as a CPA and ran an investment firm. In two separate civil lawsuits against Marshall, judges ruled that he ran a “Ponzi scheme” and stole his clients’ money, ordering him to pay more than $2.5 million to the clients.
“The investors were elderly,” the office of U.S. Attorney Thomas Kirsch said in the release. “Several were in their 70s and 80s at the time of the alleged crimes, and two are now deceased.”
Now that Marshall has been charged, Michael Anderson, one of the attorneys involved in a civil suit, said he’s hopeful his clients will get the money the court ruled they are owed. A judge ruled Marshall owed Stanley Klaybor and his late wife, Mary Jane Klaybor, $800,000 for defrauding the couple out of their investments. In both civil lawsuits, Marshall never responded to any of the legal actions and the two judges in the cases entered default judgments against him.
With Marshall reportedly nowhere to be found, the attorneys had to begin to try to track down assets so their clients could be paid. Anderson said he has had no success finding Marshall’s assets, but is more hopeful now that criminal charges have been filed. Once taken into custody, Anderson said, he hopes Marshall will divulge where he has assets.
Having worked on a civil fraud suit against Marshall, Anderson said, he was anticipating criminal charges would eventually be filed. Personally as a lawyer, Anderson said, he’s glad the justice system is holding Marshall accountable. Anderson called Marshall a “disgrace to all lawyers.”
Marshall’s investment company was named Trust & Investment Advisory Services of Indiana. Beginning about March 1998, Marshall recruited investors and promised returns of 4 to 8 percent per year, according to court documents. He provided monthly statements to investors that showed the purported balances of their investments.
But by January 2016, the Trust & Investment account was nearly empty. When investors requested information about their money, Marshall misrepresented the balances on the investments, according to court documents.
Marshall managed to pay some investors who asked to withdraw a portion of their investments by transferring money from unrelated accounts, according to court documents.
But by late 2017, Marshall stopped communicating with clients and closed his office without notifying them. They were unable to recover their investments, and lawyers in the civil lawsuits have talked about the arduous process of locating Marshall and getting the money.
A Tribune report in September, based on property records and neighbors’ accounts, found that Marshall appeared to be living in a condo in Myrtle Beach, S.C. A spokesman for the U.S. Attorney’s Office said the FBI is not sure where Marshall may be located, but he is actively wanted. A wanted poster will be circulated nationally and anyone with information on Marshall is asked to call the FBI at 1-800-225-5324.

Thoughts? The FBI just added Marshall to the most wanted white collar fugitives section of their website over the weekend. I've often stated on here, scammers and con artists are among the most underrated types of criminals, especially those who prey on the common man and woman just trying to make ends meet. And it takes a a special kind of scumbag to prey on the elderly as Marshall allegedly did.
