(AP) — Authorities say a man who served 15 years in prison, including time on death row, in the killing of a Memphis police officer has been charged with shooting a girl. According to The Commercial Appeal (http://bit.ly/1idH8WT), police say 39-year-old Timothy McKinney was arrested and charged with attempted first-degree murder after he fired shots in a convenience store Jan. 4. Police say he struck a 14-year-old girl in the leg. McKinney was convicted in the 1997 murder of Memphis Police Officer Don Williams. The conviction was overturned in 2010 when a state appeals court ruled McKinney's original attorneys did not properly investigate or try the case. Two retrials ended in hung juries before he pleaded guilty to second-degree murder and was sentenced to time served in a settlement last year. Thoughts? Even though a lot of death row inmates that get released didn't actually commit the crime they were convicted of, part of me wonders if some of these "innocent inmates" actually committed the crime but managed to get off death row by pointing out "issues in their trial or their investigation". This is one example.

It is possible in this case- that unfortunately the attorneys actually did not properly investigate or try. It seems a common complaint from those convicted.
It's hard to say in this case what happened here.
Even guys who actually are innocent of the crime they were accused of sometimes are still not model citizens. It seems there have been cases in history where a guy made a good suspect because he had a criminal past. In other words, if you're on a jury, even if the defendant is a guy who's killed nine people, it doesn't mean he killed the person he's accused of shooting in your trial. So perhaps McKinney was not a nice man but innocent of murder, or perhaps he did get away with it.
I'm sure some criminals have used that "inadequate defense" excuse just to try to get released, and others really did have inadequate defense.
It's unfortunate that a teenage girl was allegedly harmed by him. But not really sure what to think here.

McKinney was eventually found guilty of the charges and is now serving a lwop sentence on a Tennessee state prison do to his extensive criminal record I personally think he should have stayed on death row but Im happy he will be spending the rest of his life in state prison and can not hurt anyone ever Again
