A convicted sex offender, sentenced to prison, was mistakenly released on bond in Douglas County recently.
Argenis Ignacio-Bernal, 20, of Omaha was sentenced May 16 in Dodge County District Court to one to three years in prison for sexual assault of a child, a Class IIIA felony. He was transported to the Nebraska State Penitentiary in Lincoln that day to serve his sentence. Ignacio-Bernal had an immigration hold on him and would be deported to Mexico once he was released.
He was transferred to the Douglas County Jail July 12 from the Nebraska State Penitentiary in Lincoln to face a charge of first-degree sexual assault, a Class II felony.
Due to a paperwork error, Douglas County Court was not notified that Ignacio-Bernal was incarcerated on a Dodge County sentence and he was allowed to post 10 percent of a $10,000 bond and walk out of jail, said Dodge County Attorney Paul Vaughan.
A July 25 preliminary hearing was set and when Ignacio-Bernal did not show up for that hearing, a continuance was granted because Douglas County Court still did not know he was serving a prison sentence.
The Douglas County Sheriff's Office discovered Ignacio-Bernal had been improperly released later July 25 after that missed preliminary hearing, court documents showed. A bulletin sent July 25 from the Douglas County Sheriff's Office to area law enforcement agencies warned that Ignacio-Bernal was loose and that if located, he should be arrested. The bulletin also warned to be cautious of the man.
Douglas County Sheriff Tim Dunning and representatives from the Douglas County Jail did not return calls for comment.
After being informed of the bulletin and Ignacio-Bernal's release, Vaughan requested a capias warrant for the man's arrest. That warrant was issued Thursday by Dodge County District Court.
Ignacio-Bernal's last known address is 607 S. 31st St. in Omaha, but he does have at least one relative in Fremont.
In January, he was arrested at that relative's home in Fremont for having sex with a 15-year-old girl and was initially charged with first-degree sexual assault. That charge was reduced through a plea agreement.
Fremont Police were notified by the Douglas County Sheriff's Office of a phone call they had received from the victim's family that the girl had been kidnapped and sexually assaulted.
It was found that the girl had willingly gone with Ignacio-Bernal, but it is illegal for anyone 19 years old or older to have sexual relations with someone less than 16 years old, according to court records.
When Ignacio-Bernal was arrested in Fremont, a Douglas County warrant alleging first-degree sexual assault against a separate 15-year-old girl was served. The Douglas County incident happened before the Fremont incident, but Douglas County was delayed in filing charges while waiting for DNA testing results.
Fremont Detective Joyce Henke investigated the Fremont case.

This is what makes legal snafus so frustrating in that it's now 12 years and counting of Ignacio-Bernal possibly allegedly preying on even more young girls. (it was still illegal back then, but now he's even older and it's even more inappropriate if he's still doing so).
