Case Summary:
Diego Alcudia-Mendez is wanted by Douglas County and the city of Omaha authorities for the alleged sexual assault of a 14 year-old girl.
According to the Omaha World Herald archives (it will only link to a partial article so you will have to take my word for some of the summary), Alcudia-Mendez turned himself in at the Douglas County jail after admitting he had impregnated a 14-year old girl. The girl confirmed the accounts of Alcudia-Mendez and her pregnancy. This is according to Omaha Police reports.
Pending paternity tests, Prosecutors planned to charge Alcudia-Mendez with 1st degree sexual assault under a state law that makes it illegal for adults to have sex with anyone under 16.
However, once Alcudia-Mendez learned he was facing 50 years in prison, he allegedly panicked.
On April 17, 2009, he posted $10,000 which was 10 percent of the $100,000 bail set at the outset of his case by Douglas County Judge Joseph Caniglia.
Still, Alcudia-Mendez was an illegal immigrant and had a problem: Immigration and Customs Enforcement agents were holding him, without bail, as he awaited deportation proceedings.
So Alcudia-Mendez asked a judge to set bail in federal court.
U.S. Immigration Judge Daniel Morris of Omaha granted Alcudia-Mendez's request, setting bail at $100,000 on May 13th, 2009.
Soon after, Alcudia-Mendez posted $10,000, the required 10 percent, with ICE.
He hasn't been seen since.
Thoughts? I also want to say I also found this case on an anti illegal-immigrant website. I am not accusing them of being racist or anything but I'm purposely declining to mention them since I'm not trying to make a political statement here. Just feel this guy should be caught for what he allegedly did to the 14 year old girl. These are the types of illegal immigrants who should be deported. Not hard-working law abiding citizens here for 20 plus years or young people who were born in this country to immigrant parents who have also been law abiding. (The dreamers so to speak). There needs to be comprehensive immigration reform in this country, but in a way that's fair and humane. (Ok I got sort of political anyway. Oh well).
Also, Alcudia-Mendez is still listed as wanted under Douglas County's online warrants search as of 1/27/2018.
