Kongvannark "Ricky" Maloney is one of the Rhode Island State Police's 10 Most Wanted fugitives.
Maloney and a then 21-year old co-defendant, Felix Olivares were charged with murder in relation to the the August 9th, 2013 death of 20-year old Johenlly Gabriel Espinal.
On Aug. 9, 2013, Providence, Rhode Island police detectives and state prosecutors say the two men rammed their vehicle into Espinal’s car as he was leaving a housing project. Espinal sat stunned in his car, the police said, and Maloney is accused of jumping from his car and firing the fatal shot.
At the time, Espinal’s father, Gabriel Espinal, said Maloney had been threatening to kill his son for months for dating Maloney’s former girlfriend.
A few months earlier, in April 2013, Espinal said Maloney shot at his son and his girlfriend as they drove on Cranston Street in the city’s West End. His son also received threatening phone calls from Maloney, he said.
Maloney is a known member of the Youngbloods, a well-known street gang in Providence.
In July 2013, the police charged Maloney with felony domestic assault and simple domestic assault for an alleged attack on his ex-girlfriend. Those charges remain pending in state court.
In April 2014, the U.S. Marshals Service and the Rhode Island State Police captured Olivares, who was hiding in an apartment in Brooklyn, N.Y. A statewide grand jury indicted Olivares and Maloney for murder, conspiracy and discharging a firearm during a violent crime.
Olivares would soon go on trial as his defense attorney would argue that he was only a passenger in Ricky's car and never fired a weapon, stressing it was a crime of rage and that it was Maloney, who had dated Espinal's ex-girlfriend, that had the motive. The Prosecution countered that Olivares also got out of the car and fired shots and that he was identified by both Maloney's ex-girlfriend and two other women as getting out the car and firing shots.
Ultimately, Olivares would be found not guilty, breaking into tears and repeatedly hugging his defense attorney after the verdict.
While the case against Olivares is now officially over, Ricky Maloney is still at large.
Thoughts? I want to stress that even though Olivares was found not guilty it was based on the defense that Maloney was the sole aggressor in this case. So while Maloney is admittedly also innocent until proven guilty, the fact that Olivares was acquitted based on the defense that Maloney was the sole shooter along with the Espinal dating his ex-girlfriend (in other words a motive) it does not look good for him. (Legally speaking, eyewitness identification is not always reliable and Maloney was the one who had the motive and history of threats, not Olivares. Innocent does not always mean 'innocent' but it does mean reasonable doubt, and there was certainly reasonable doubt in Olivares' case so I am not surprised by the jury's decision).
Please keep in mind Maloney is also an alleged gang member who also allegedly attacked his ex-girlfriend. (You gotta love the morality there. I'm going to allegedly kill guys who date my girlfriends because I love my girlfriends so much that I physically abuse them).
So this is a very dangerous fugitive. So if you see Maloney, you should be careful, but should also call the Rhode Island State Police.
