Saul Chavez is wanted by the FBI and the Chicago Police Department for his alleged involvement in a hit-and-run accident that resulted in the death of an elderly man in 2011.
On June 8, 2011, a sixty-six-year-old pedestrian was struck by a vehicle, allegedly driven by Chavez. After being struck, the pedestrian was dragged under the vehicle for approximately 265 feet and died as a result of his injuries. Chavez allegedly exited the vehicle and attempted to flee on foot. He was apprehended after a brief foot chase.
Chavez was charged with aggravated Driving Under the Influence (DUI)/death by the Circuit Court of Cook County, Illinois, and a state warrant was issued for his arrest on November 28, 2011. A federal arrest warrant was issued by the United States District Court, Northern District of Illinois, Eastern Division, on January 9, 2012, after Chavez was charged federally with unlawful flight to avoid prosecution.
Thoughts? There is a Chicago Tribune article that goes into some very disappointing details as to how Chavez was able to flee. Chavez already had a DUI conviction mind you. Here is an excerpt:
Chavez was charged with a felony — aggravated driving under the influence — and held on a $250,000 bond. The Cook County sheriff's office said Chavez had a blood alcohol content of 0.29 percent. Convicted of a DUI in 2009, he had just finished the two-year probation sentence.
"Two days after the fatal accident, on June 10, the federal Department of Homeland Security filed what is called an immigration detainer for Chavez. The agency believed he was an illegal immigrant from Mexico. The form requested that Cook County notify Immigration and Customs Enforcement, known as ICE, if Chavez was scheduled to be released.
But as Chavez sat in the jail, immigration became an emotional issue before the Cook County Board. Board President Toni Preckwinkle and Commissioner Jesus "Chuy" Garcia pushed a new policy aimed at ignoring federal detainer requests and allowing suspected illegal immigrants who'd been jailed in misdemeanor or felony cases to make bond."
After it passed...
"Thanks to Preckwinkle, Garcia and their friends on the county board, Chavez was released on bond Nov. 20. He put up $25,000 of the $250,000 bond amount, and walked. He missed one court date. Then prosecutors sought an emergency increase in the bail amount, and warrants were issued for Chavez's arrest. He missed a second court date. He was gone."
Now I'm not sure if the policy changed to allow people with serious and/or multiple offenses to have detainers honored, but it's too late in this case anyway.
I rarely try to get too political on here. But I am usually on the more lenient side when it comes to the immigration debate, realizing that unless you're Native American, your ancestry is from somewhere else. There is a problem with illegal immigration and crime however there are a lot of illegals here who are law abiding citizens, and many of whom do work no one else does as well. There needs to be reform for both those here legally who are and aren't law abiding citizens. However, this case is absolutely ridiculous and Chavez is in Mexico now, possibly forever, because of what happened. I understand about the misdemeanors, that I had no problem with technically, but to allow a guy like Chavez accused of a felony bond- once again- beyond ridiculous.
Let's hope the FBI, and hopefully the public as well, can right a wrong and send Chavez back to Chicago to face justice.
