A Roswell man shot during an alleged armed robbery in Portales last month died early Tuesday.
Brady Vallejos, 19, was pronounced dead Tuesday at 6:18 a.m. at the University Medical Center in Lubbock, Andrea Reeb, district attorney in the New Mexico 9th Judicial District, said Wednesday. Vallejos was being treated at the time for a gunshot wound to the head.
Five people are facing multiple criminal counts in connection with the Sept. 11 robbery and shooting.
A 14-year-old man believed to be the shooter, along with Diego Morales, 18, and Jonathan Mendez, 19 — both from Portales — will be charged with felony murder, Reeb said.
She added that a notice of intent has been filed by the District Attorney’s Office to seek adult sanctions against the 14-year-old.
A second juvenile and Ashlie Alarcon, 18, of Portales are charged with armed robbery; conspiracy to commit armed robbery; and tampering with evidence in connection with the incident. Alarcon also faces one count of contributing to the delinquency of a minor.
In addition to murder, Reeb said Morales, Mendez and the 14-year-old suspect face one count each of armed robbery; shooting at or from a motor vehicle; aggravated burglary, deadly weapon; armed robbery, conspiracy; and tampering with evidence.
The 14-year-old also faces one count of assault to commit a violent felony, while Mendez and Morales are each charged with additional criminal counts of shooting at a dwelling and contributing to the delinquency of a minor.
Court documents state Vallejos was shot once in the head while sitting inside a white Honda vehicle on the afternoon of Sept. 11 in the 500 block of New York Drive in Portales.
A man from Dexter who was at the scene when Roosevelt County deputies arrived said that he and Vallejos came to Portales that day to sell some Xanax pills to someone they communicated with online, according to court documents.
When they arrived at the location, he said that he and Vallejos were approached by two armed Hispanic men.
Vallejos was then shot in the head by one of the two armed men, while the other gunman allegedly forced the man from Dexter down onto the ground.
Both armed men, according to court documents, then allegedly took a bag from inside the vehicle along with a pack of Marlboro cigarettes that contained the Xanax.
Shots were then fired into the tires of the Honda before the two armed men left in a black SUV. The man from Dexter also said he heard a female voice during the incident.
Investigators were led to the suspects through search warrants executed on electronic devices and locations, as well as interviews with witnesses and suspects.
Court documents state when Morales and Mendez were interviewed, both reportedly admitted to robbing Vallejos and that the 14-year-old with them had shot Vallejos.
After the five suspects left the scene, court documents state they went to a residence where they allegedly buried a rifle that was used in the robbery.

Thoughts? As of today, February 20, 2022, Diego is on the Roosevelt County Government's website as one of their most wanted fugitives. The New Mexico court records database indicates that he is not in custody ever since he failed to appear in court. Just to clarify, this thread is only to discuss the fugitive status of Diego Morales, not anyone else involved in this case.
