In retrospect it might have actually helped the Prosecution if Mary Nunes had pre-packaged testimony. It would show Dr. Kelley has a history of trying to manipulate and control situations with no one present. But I'm glad the Judge ruled the other way since now we may finally locate Mary.

A Judge has denied a motion to dismiss the lone charge against Kelly. Yep you heard that right, the woman who took a daughter still missing after 10 years tried to have her lone charge dropped. I guess you can't fault them for trying.... The Judge also admonished both the Prosecution and Defense for wanting to present evidence that has nothing to do with the case. Ok, since I e-mailed them privately and they still haven't corrected it I'll call them out. A newspaper called "Morning News USA" (don't know if it's only online or not) has the headline on their website "Sexually Abused Daughter Mary Nunes Appears In Court." So many things are wrong here. One- did she appear in court? I thought she was just located. Also "Sexually abused." Not only is there no allegedly but they make it sound like Mark Nunes is the one on trial when it's Mrs. Kelley who is. Is it that hard to put "allegedly."? if that's the angle you're going for? Say what you want about our site, but I go out of my way to put allegedly in threads and stress the assumption of innocence of the fugitives. (Which of course still isn't good enough for many whiny family members or friends of the alleged fugitives- but at least we try). It appears now Mary Nunes has appeared in a Colorado court and made a notorized statement asking to be with Genevieve and Scott Kelley. She reiterates the claims that Mark Nunes abused her. It is tough here- I certainly think it's possible Mary BELIEVES she was abused. The question in my opinion is if she was brainwashed into believing it. So many tightropes to be walked on. Dr. Kelley and Scott are still technically innocent. You also don't want to not believe a girl who says she was abused and say she's not telling the truth. At the same time, New Hampshire authorities did not see any reason to think Mary was abused, and Mark Nunes should not be unfairly accused if he did in fact did nothing wrong, especially considering the fact he's not the one on trial. As I said the trial will decide everything but for me, what I'm thinking is- if the allegation abuse is true- why would Mark Nunes go completely out of his way to find his daughter? Hiring a private investigator, getting the case on AMW, getting the case on The Hunt. Do you know the huge risk that would be taken if a guy who actually sexually abused his daughter opened himself up to that much publicity and made such a high profile effort to locate her? I hate cases like this. It's so hard to find the truth about what happened, and you don't want to accuse either side of lying, especially when a child is involved.
If you've never read the story of Bobby and Kristi Baskin, I highly recommend you check it out. They were a frequently-aired Unsolved Mysteries case about two siblings abducted by their grandparents. They were missing for 20 years until, out of the blue, they were located! The children claim that their parents were abusing them and that their grandparents rescued them, and as far as I know, they have refused to meet with their parents. What's tricky in that instance is that they are both adults now, and you can't force an adult to do something (you can't force a child either, but it's much more challenging as an adult). It's a super sad case.

Can't believe I missed this. On June 17th, 2015, Genevieve and Scott Kelley plead guilty to misdemeanor charges of custodial interference. The plea deal calls for Genevieve Kelley to serve 10 months in jail after Scott Kelley serves five months; the sentences were staggered so their 10-year-old son will not be without a parent. Apparently, Scott has already been serving his sentence. It's hard to feel too good about this outcome though- Mark Nunes never got a chance to prove he never did anything wrong to a Jury, and Mary apparently still doesn't want to see him. She apparently is going to wind up living with her abductors (custodial interferers, whatever the correct term is for the case they both plead guilty to) eventually anyway. But at least there will hopefully be a peace of mind with Mr. Nunes now that he knows she's safe and alive. Mary's an adult and can do what she wants now- fortunately or unfortunately. I assess the whole trial as bu******! They give the abductors, who'd been gone about a decade, a slap to the wrist, they take away Mark Nunes' chance to tell his side of the story, and they refuse to advise Mary on Mark's, Genevieve's, and Scott's histories. The decision Mary had to make was based on what I could only call a biased court case. What the (beep) was wrong with the prosecution?

An update: Both Genevieve Kelley and Scott Kelley have completed their prison sentences- and believe it or not, apparently want a book and movie deal about their experiences. (What is it with former AMW fugitives becoming "celebrities"?) The Judge ordered the Kellys to designate any profits from the book or movie rights to their story for a trust fund for Mary, and barred them from hindering Mary's relationship with her father if she wanted one. What can I say- the only happy news in this case is we found out Mary was alive and safe and I guess that's the main important factor.
