Two of three missing children are in custody of the Texas Department of Family and Protective Services after their mother’s arrest on Tuesday morning following a three-month, multi-agency investigation.
Records show 27-year-old Amanda Martinez was booked into the Lubbock County Detention Center early Tuesday on a state felony charge of interference with child custody.
Their maternal grandmother, 44-year-old Deanna Martinez, has been in police custody since Dec. 26, after she was arrested in Albuquerque, New Mexico, where officials say 8-year-old Mariah Martinez may still be.
Since October, detectives with the Lubbock Police Department’s juvenile unit have been working with Child Protective Services in an effort to locate the children after they were reported missing by a CPS investigator, LPD spokeswoman Tiffany Pelt said in a statement.
“After questioning the mother, police believe the 8-year-old female child is still in the New Mexico area.”
Pelt said the mother was arrested at 2:45 a.m. in the 8900 block of University Avenue where she was staying after police were advised that the children were being dropped off at the residence.
The arrest comes more than a month after an indictment was handed down.
A capias through the state of Texas was issued Nov. 30 for the arrest of Deanna Martinez and her daughter Amanda on a state felony charge of interference with child custody.
The two were indicted after investigators say they knowingly took or retained 8-year-old Mariah Martinez, 4-year-old Jeremiah Martinez and 2-year-old Leimiah Martinez in violation of court-approved custody orders to remove the children stemming from allegations of abuse.
On Oct. 21, a CPS investigator contacted local law enforcement to file a missing person report on behalf of the three siblings following court orders to remove them from Martinez’s custody amid allegations of abuse.
At the time of the initial LPD news release, officials said they believed the children were with family members in New Mexico.
Documents show Deanna Martinez’s first court appearance took place in Metropolitan Court in Albuquerque a day after her arrest. She was booked into the Lubbock County Detention Center on Dec. 30.
Allegations were detailed in an affidavit obtained by A-J Media in November, in which Jeremiah Martinez met with a CPS investigator during a school interview in early October.
Jeremiah reportedly told the investigator his mother’s boyfriend punched him in the nose as he tried to stop a fight between the couple.
Showing a history of violence, records show the mother’s boyfriend allegedly “threatened to drive the vehicle into the pond and kill the family.”
According to the records, concern of sexual abuse arose after Jeremiah told investigators his family lived in the 6400 block of 37th Street with his grandfather, 45-year-old Christopher Martinez — a registered sex offender convicted of aggravated sexual assault in 2002.
During the CPS school interview with Jeremiah, school officials also told investigators they were concerned for Jeremiah’s older sister as she had missed a week of school.
Over the course of the investigation, drug tests were administered.
The affidavit shows Amanda Martinez, along with the children’s maternal grandmother, Deanna Martinez, reportedly tested positive for methamphetamine.
Christopher Martinez, the children’s grandfather, reportedly used marijuana.
CPS history showed an investigation in 2006 in which Deanna Martinez was allegedly allowing her teenage children to drink alcohol and smoke marijuana, possibly providing them with the substances.
The case closed out weeks later with the investigator stating Deanna is “self-absorbed and detached from the children.”
She had a warrant for her arrest at that time.
Amanda Martinez was first arrested on Nov. 1 after she was found in contempt of court after refusing to disclose the location of the children, records state.
Told the children were in Albuquerque, New Mexico, with a maternal uncle, investigators reached out to him, saying he denied having the children with him.
The investigation continues as officials work to locate Mariah Martinez.
She is described as an 8-year-old Hispanic female with black hair and brown eyes, 4-feet-2, weighing 57 pounds.
