Kelly and her sister Kimberly were abducted by their non-custodial mother, Elaine Carolyn Yates. Elaine found her husband, Russell M. Yates Jr., with another woman. They argued and he admits he hit her, but says it was only after she hit and kicked him several times, and he stated this was the first and only time he had ever struck her. Russell took her to the emergency room for treatment, and the staff there suggested Elaine move to a battered women's shelter in Massachusetts. Three weeks later, she left with the children while her husband, who owned a bar, was at work; he came home at 2:00 a.m. to find the house empty. Russell filed for custody of them and was granted this in November 1985 when Elaine didn't appear in court to contest his petition. However, by then she and the girls had vanished.
In 1986, Russell sued Elaine's mother, Mary Pigeon, alleging she had helped Elaine abduct the children, lied several times in her statements to law enforcement, and knew where the three of them were hiding. In 1989, the judge ruled in his favor and ordered Pigeon to pay Russell $23,000 in damages and tell him where Elaine, Kimberly and Kelly were. She claimed she had last spoken to Elaine in September 1985, didn't know her daughter and grandchildren's whereabouts and wanted them to return home. She appealed the ruling but it was upheld. In June 1990, Pigeon, who was 77 years old at the time, was found in contempt of court and ordered to perform 60 hours of community service a month at the <i>Society for Young Victims</i>, a missing children's agency, and also read their files about missing children, until she revealed her suspected knowledge. By September, she still hadn't disclosed any information and the judge had her jailed in the minimum-security wing of the Adult Correctional Institute in Cranston, Rhode Island. She was released eight days later, after the judge concluded further coercion would not be effective. He did not, however, revoke his earlier ruling that Pigeon must give the information. Pigeon always maintained she didn't know anything about the abduction and didn't know Elaine, Kelly and Kimberly's location. She died in 2000.
Photos and vital statistics for Elaine are posted below this case summary. A felony warrant for Child Snatching was issued for her on November 16, 1988, but Russell didn't formally divorce her until 1996. Neither she nor her daughters have ever been heard from again.
Thoughts? Obviously a very complicated case but it would still be nice to know Kelly and Kimberly are safe and alive.
